Parents: “alimony shouldn’t include school payments for young people over 18 years old”

Paying school is still a controversy for men who pay alimony. Now, they argue that this category should not be paid in case of young men over 18 years.

The proposal is headed by the Foundation Institute to Support Man (FUNDIAPHO), entity that plans to file a massive habeas corpus to repeal that that amount.

According to the complaint, judges from the Constitutional Court should issue a serious thought and analyze the exposed legal justifications.

The school payment is a compulsory saving monthly deducted from employees and its purpose is to provide alimony recipients an additional resource to meet the expenses.

If these adult children finish high school and are getting ready to start higher education, they are entitled to this payment.

However, FUNDIAPHO argues that it should not apply since the beginning of the trimesters or semesters does not fix with the payment date, which is in January.

In January this year, several parents asked authorities not to include the school payment in the same amount of ailmony. According to many of them, it is abusive and expenses need to be shown, to determine the obligation of the debtor.
