Association files criminal complaint against the President for exploitation in river

The Asociación Confraternidad Guanacasteca filed a criminal complaint against President Carlos Alvarado and the Minister of the MINAE, Carlos Manuel Rodríguez, for the granting of a mining concession for the exploitation of Rio Brasil in Sardinal de Carrillo, Guanacaste.

Gadi Amit, president of the Association, told CRHoy.com that the complaint was filed with the Attorney General, Emilia Navas, because they are members of the Supreme Powers of the Republic.

The concession was granted to the company Constructora Magnate Sociedad Anónima, whose legal representative is Francisco Morice Zamora.

According to Amit, in the resolution signed by Alvarado and Rodríguez, which came into force on March 1st, mentions the exploitation of sand and stones from Rio Brasil in Sardinal, but ends up being granted to the area of the river in Juntas de Abangares.

Surely they’ll say it was a mistake. It was our first hypothesis. However, it is not admissible at those levels of government and responsibility to allow this type of mistakes, without punishing those responsible, so that future damages are avoided. In addition, we have an aggravating circumstance that has not been warned,”

says the Association in the complaint filed.

The president of the Association said that the concession was granted for another site, as established in the resolution, but Rio de Carillo Brasil is being exploited, which he said is illegal.

Amit also explained that the Environmental Viability granted by Setena is for two years and it was given on December 14th, 2016.

According to Amit, this makes the environmental viability expire on December 14th, 2018. “This alone, and makes it illegal to grant a right, without the confusion of the sites indicated for mining,” said the president of the Association.
