ARESEP seeks to hold Uber responsible for operating illegality

The Public Services Regulatory Authority will open an investigation to determine what legal responsibilities Uber or related companies may have for providing remunerated transportation services without a concession or permission from the Public Transport Council (CTP).

The General Direction of Attention to the User will carry out the process of investigation.

Marta Monge, director general of this office, stated that the objective is to establish who is responsible and what they would be responsible for.

Following the compilation of evidence, the working group will make a document with relevant recommendations for the Office of the Regulator.

Despite the fact that the Attorney General’s Office (PGR) indicated that it could not refer to the case, because it is in judicial instances, ARESEP assures that it will maintain its policy to fine those drivers who provide the remunerated service to passengers without the authorization by the State.

The fines range from 1.2 million to 8 million colones.

According to the law, a concession or a permit issued by the Public Transport Council (CTP) must be available to provide a paid transportation service.

If this requirement is not met, it is an illegal or unauthorized service, according to the Constitutional Chamber.
