Public universities presidents file lawsuit against decree regulating tax plan

The presidents of public universities filed a claim with precautionary measure before the Contentious-Administrative Court against the Ministry of the Presidency, the Ministry of Finance, the Ministry of Planning and Economic Policy (Mideplan) and the State.

This action was raised against article 1 clause h) and article 3 of the executive decree issued by Mideplan on February 18th, called Regulation of Title III of the Law of Strengthening of Finance Public; Law No. 9635 of December 3rd, 2018, regarding public employment.

Some of the main arguments that support this claim point out that “the regulation of the employment regime of public universities is a matter reserved for these institutions, and since their creation they have been excluded from the application of the Civil Service regime,” reported the University of Costa Rica through social networks.

The provisions contained in the Law on Salaries of Public Administration, typical of the Civil Service regime, do not apply to state universities,”
