Head of Restoration doubts civil union project

September 26, 2019 by Staff News Writer

The head of fraction of the National Restoration Party (PRN), Eduardo Cruickshank, acknowledged that he has doubts about the bill to avoid gay marriage and only allow civil unions, promoted by the Christian Social Unity Party (PUSC) and the independent New Republic block.

According to the legislator, he does not know if the initiative would have a legal basis after Court IV declared subsection 6 of article 14 of the Family Code, which prohibits same-sex marriage, in August 2018.

It seems to me that part of the foundation of the project (of civil unions) is precisely Article 14, subsection 6, and sice it’s canceled, because it is technically canceled, I have my doubts,”

said Cruickshank.

The legislator said he will study the project comparatively with the integral resolution of the Constitutional Chamber before making a decision.

The PRN bench will make a decision at its usual meeting next Monday, after studying the 108-page proposal.

The project promoted by the PUSC intends to regulate civil unions between people of the same sex as of May 26th, 2020, at the end of the 18-month period given by the Constitutional Chamber to the Legislative Assembly to adapt national legislation to his sentence.

If before that date the Congress does not make a decision, subsection 6 of article 14 will remain in force, in accordance with the judgment.

According to the promoters of the new initiative, the figure of the civil union is the one that “best adapts to the state of social, political and legal evolution of the country.”

So far, the proposal, still in draft, has 25 signatures.
