A consultation regarding Improper Relations Law was sent to the Constitutional Court

September 13, 2016 by Staff News Writer

Twelve legislators signed an Improper Relations Law`s consultation to the Constitutional Court. This law punishes with imprisonment relationships between adults and minors.

Lawmakers who signed the document are Otto Guevara, Natalia Díaz, José Alberto Alfaro, Aracelly Segura, Michael Arce, Juan Luis Jiménez Succar, Juan Marín, Danny Hayling, Gerardo Vargas Rojas, Luis Vásquez, Jorge Rodríguez and Carlos Hernández.

The consultation was delivered last Thursday as part of a political agreement with the Partido Libertario to allow the voting process in the first reading.

If it is not a rape, the regulation punishes with imprisonment adults who have oral, anal or vaginal sex with a minor. It goes as follows:

-3 to 6 years of prison when the victim is older than 13 years old and younger than 15 years old and the adult is 5 or more years older.
-2 to 3 years of prison when the victim is over 15 years old and under 18 years old and the perpetrator is 7 or more years older.
-4 to 10 years of prison if the adult is a minor’s blood relative such as an uncle, an aunt, a brother or a sister, a cousin by blood or affinity, if the adult is a legal guardian or is in a position of trust or authority over the victim and the family.

The Constitutional Court has up to a month to decide.
