Company must remove material and demolish wall due to damages in Playa Hermosa

The Criminal Court of Puntarenas ordered the company Geldstuck to remove material from the land and demolish a perimeter wall in the Hermosa Beach sector in Garabito. The Public Prosecutor’s Office informed that the ruling came after the accusation of the Deputy Environmental Agrarian Prosecutor.

The Court issued an injunction against the developer of a condominium project in the area. This was finalized by the Criminal Court of Puntarenas on April 3rd. The company was convicted of the crime of wetland drainage.

In addition, the Municipality of Garabito was ordered to carry out the aforementioned works if the company fails to comply.

The investigation began in September 2017, after a complaint about the damage to the ecosystem. The Prosecutor’s Office requested investigative measures, including expert opinions, which were provided as evidence and served as the basis for the precautionary measure ordered.

The case is still under investigation in the evidence collection phase, according to the Public Prosecutor’s Office in a press release.
