Project seeks to remove obstacles to marriage dissolution

A reform would allow the dissolution of marriages with only the unilateral will of one of the spouses.

The proposal presented by several legislators is part of a set of changes to the Notarial Code seeking to speed up a lot of paperwork for Costa Ricans planning to get a divorce.

The initiative clearly states that the unilateral dissolution of a marriage would only be allowed if there are no underage children and community property.

The bill contains other rules to ensure transparency and prevention of fraud and other crimes.

One of the goals is to incorporate information and communications tools and technology to notaries.

The notary will be allowed to carry out mortgage processes, recognition of children from other unions, and other processes that take time in the courts.

The initiative also seeks to improve the sanctioning system through the implementation of orality processes, as well as a fund of mutuality and retirement for the benefit of persons exercising the profession of notary, by creating a series of credit and financial benefits.
