State and agricultural companies sued over national park lands

The State, the National Registry and Agropecuaria Volcán SA are listed as defendants in the dispute over 166 of the 14,083 hectares that make up Rincón de la Vieja National Park.

The complaint was lodged by Walter Brenes, activist and lawyer specializing in environmental issues at the Energy Law Firm (ELAWF).

Brenes, among other things, requests that this amount of land -now in the name of Agropecuaria Volcán- be returned to the Costa Rican State.

According to the complaint of the legal representative by resolution of March 1st, 2016, the Real Estate Registry established that

… it has been fully demonstrated … there are sufficient cadastral technical merits to verify the existence of inconsistencies in the cadastral settlement,”

where it is demonstrated with evidences that the error in the inscription of the lands that belong to the State.

The lawsuit of Brenes asks the Contentious Administrative Court to order the total cancellation of the registry entries of the Alajuela Party and Plano Catastrado farms registered in the name of the company Agropecuaria El Volcán SA, owned by Kirsten Figueres and William Paniagua, with the objective of returning the 166 hectares as state patrimony, which belong to all Costa Ricans.
