Strike in MEP is illegal because it affected student’s nutrition

The Labor Court of the Second Judicial Circuit of San José declared that the 81-day strike in the Ministry of Public Education (MEP) is illegal.

Since it is not a peaceful movement, because it affects essential services such as the nutrition of students who depend on these services and the principles of reasonableness and proportionality are violated, this judge concludes that it must be declared illegal,”

indicates the sentence.

He adds that

it is inevitable not to think that this population has been affected by the prolongation of the strike movement; the data shows that practically in all educational centers the impact was more than 50% of closed dining rooms […] which can seriously affect the student population that depends on this food service.”

Judge Víctor Orozco also ruled that pursuant to Article 563 of the Labor Code the present case is resolved without special condemnatory costs to the unions Association of Teachers of Second Education (APSE), the National Association of Educators and Educators (ANDE) and the Union of Workers and Workers of Costa Rican Education (SEC).

The parties are advised that this resolution admits the appeal, which must be filed before this Court within a period of three days,”

states the document.

On November 19th, the Court of Appeal of the Second Judicial Circuit of San José, annulled the j first sentence on the strike in the MEP, so that the process for the declaration of legality or illegality was returned to the court to make the necessary corrections.
