Treasury is concerned about the tax reform submitted to the Congress

Helio Fallas, Minister of Finances, expressed his concern about a group of tax reforms proposed by the Bar Association to be included in the Anti Fraud Tax project,. He believes that it could weaken the penalties for these offenses.

Among the proposed changes there are:

-To reduce the minimum penalty for tax offenses such as in countries like the United States, Germany and Spain, where a penalty of just 5 years in prison is established.

-To clarify whether the type of crime includes ruse and deception and it is not just the mere breach of the tax rules.

-To clarify that the prosecution can cite in the criminal indictment aspects that were not previously included in the Ministry of Finance complaint.

If the proposed changes are passed, about 24 processes could benefit from them.
