First Costa Rican gay marriage in limbo

The marriage between Jazmín Elizondo and Laura Flórez-Estrada is in a legal limbo, since there now is process to determine whether it should be invalidated or not.

There are 3 procedures that would determine if the marriage is still valid: a trial for unconstitutionality, another one for criminal charges and a process opened by the Attorney General of the Republic.

According to the couple’s lawyer, Roberto Zamora, the process is ongoing but does not make any progress.

The debate is due to paragraph 6 of Article 14 of the Family Code, which forbids unions between same-sex couples.

However, the 2 women were able to get married in Costa Rica because there was a mistake registering Jazmín’s genre, indicating that she was a man. Such mistake was swiftly amended, which set Zamora to appeal on the grounds unconstitutionality, but that was suspended due to the existence of unconstitutionality prior to the appeal.

I have no idea why it was suspended by the unconstitutionality, because it has nothing to do with the subject. The appeal is for them to explain why Jazmín’s genre was so urgently declared,

said Zamora.

According to the lawyer, they are facing a discriminatory case.
