MEP moves holiday from October 12th to next Monday

About 980 thousand students attending public educational centers must participate in the civic events that will take place on Saturday, October 12th. This is stated in circular DM-0033-10-2019, sent by the administrative vice minister, Steven González, on October 4th.

Likewise, the document states that the holiday will be enjoyed on Monday, October 14th, by students, teachers, technical and administrative staff.

According to article 148, of the Labor Code, the holiday of the month of October must be transferred if the date falls on the days Tuesday, Wednesday, Thursday or Friday; therefore, all employees must enjoy the holiday, but not everyone will receive payment for that day.

However, those workers who work and get paid for hours (not biweekly or monthly) or who have weekly payment and are not trade, will enjoy the holiday, but they will not be paid the salary of that day.

No employee may be forced to work on a holiday, as indicated in article 149 of the Labor Code. However, there is an exception for employees who work in establishments that, due to the nature of the service or business, provide essential functions and services for citizens, such as hotels, pharmacies, restaurants, health services, among others.
